Terms of Service

These Terms of Service ("Terms") are a binding agreement between you and ShotGain ("ShotGain," "we," "us"). They govern your access to and use of our mobile applications, website at shotgain.com, APIs, and related services (collectively, the "Service"). By creating an account, downloading the app, or using any part of the Service, you agree to these Terms and to our Privacy Policy.

1. Who Can Use the Service

You must be at least 13 years old to use ShotGain. If you are between 13 and 18 (or the age of majority in your jurisdiction), you must have permission from a parent or guardian. You may not use the Service if you have been previously banned or if doing so would violate any law where you live.

2. Your Account

• You're responsible for keeping your password secure and for everything that happens under your account.
• Provide accurate information at signup and keep it current.
• Notify us promptly at support@shotgain.com if you believe your account has been compromised.
• One account per person — accounts are not transferable.

3. Subscriptions, Trials & Billing

ShotGain offers paid subscriptions ("ShotGain Pro") with a free tier of access. As of the date of these Terms, paid plans include:

• Monthly — $9.99 / month, billed monthly
• Annual — $79.99 / year, billed once per year
• Free trial — 7 days of Pro features, free of charge, when you start a new subscription. You can cancel any time during the trial without being charged.

Subscriptions are sold through the Apple App Store and Google Play. All payments, refunds, taxes, and renewals are handled by Apple or Google — not by ShotGain directly. Subscriptions auto-renew at the end of each billing period unless you cancel through your App Store / Google Play account settings at least 24 hours before the renewal date.

Pricing may change. We'll give you advance notice (at least 30 days) before any price increase takes effect on your existing subscription.

Refunds

Refund requests are handled by Apple or Google through the store you purchased from. We do not have the ability to issue store-side refunds directly, but if you believe you have been charged in error, email support@shotgain.com and we'll help you through the right channel.

4. License to Use the Service

We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the Service for your own non-commercial use, subject to these Terms. Everything else — the software, branding, content we create, and the underlying algorithms — is owned by ShotGain or its licensors.

5. Your Content

You own the rounds, shots, notes, and other content you create in ShotGain ("Your Content"). By using the Service, you grant ShotGain a worldwide, royalty-free license to host, store, reproduce, and use Your Content as needed to operate, improve, and provide the Service to you. This license ends when you delete the content or your account.

We may use de-identified, aggregated golf data (e.g., "average dispersion at 150 yards across all users") to improve recommendations and benchmark features. This aggregated data cannot reasonably be linked back to you.

6. Prohibited Conduct

You agree not to:

• Reverse engineer, decompile, or attempt to extract source code from the app.
• Use automated tools to access the Service in a way that imposes unreasonable load.
• Submit content that infringes others' rights, contains malware, or violates the law.
• Impersonate someone else or misrepresent your affiliation with any person or entity.
• Attempt to bypass billing, subscription gates, or rate limits.
• Resell, redistribute, or sublicense the Service or any data from it.

7. Third-Party Services

The Service may link to or integrate with third-party services (Apple App Store, Google Play, Supabase, RevenueCat, Google Analytics, Meta, TikTok, etc.). Your use of those services is governed by their own terms and privacy policies. We are not responsible for the content or practices of any third-party service.

8. Termination

You can cancel your subscription and delete your account at any time. We can suspend or terminate your access if you violate these Terms, abuse the Service, or if we're required to by law. If we suspend or terminate, we'll give you reasonable notice except in cases of clear abuse or legal urgency.

9. Disclaimers

ShotGain is provided "as is" and "as available." We do everything we can to keep it accurate and reliable, but we don't guarantee any specific golf-score improvement, the precision of GPS-based metrics, or that the Service will be uninterrupted or error-free. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

10. Limitation of Liability

To the maximum extent permitted by law, ShotGain and its team will not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from or related to your use of the Service. Our total liability to you for all claims in any 12-month period will not exceed the greater of (a) the amount you paid us in that period, or (b) $50 USD.

11. Indemnification

You agree to defend and indemnify ShotGain from claims, damages, and expenses (including reasonable attorneys' fees) arising from Your Content, your violation of these Terms, or your misuse of the Service.

12. Governing Law & Disputes

These Terms are governed by the laws of the State of North Carolina, USA, without regard to its conflict-of-law rules. You and ShotGain agree to resolve any dispute exclusively in the state or federal courts located in Mecklenburg County, North Carolina, except where applicable consumer-protection law gives you the right to bring claims in your local courts. If any provision of these Terms is found unenforceable, the rest stays in effect.

13. Changes to These Terms

If we materially change these Terms, we'll notify you at least 30 days before the changes take effect, by email or via an in-app notice. Continued use after the effective date means you accept the updated Terms.
